On the 5th of May 2016 a new version of theYork-Antwerp Rules was adopted at a Comité Maritime International Assembly. The new version of the Rules has been extensively reviewed mainly in conjunction with the International Group of P&I Clubs, the international Average Adjusting Community, National Maritime Law Associations, the International Chamber of Shipping, BIMCO and IUMI. The general consensus is that the YAR 2016 have addressed all contentious areas of the 2004 amendment, such as the allowance of salvage remuneration in General Average (GA Rule VI), the allowed expenses at the port of refuge (Rule X), the treatment of temporary repairs (Rule XIV), the exclusion of low value cargo from contribution and the provisions relating to Commission and Interest. In addition to the adoption of the new rules, the IWG has developed guidelines which, although they are not binding and do not form part of the YAR 2016 they provide background information on the basic principles and guidance in respect of the adjusting procedures relating to GA. It is hoped that the new rules will promote cost efficiency as well as uniformity in dealing with GA. However, it remains to be seen whether YAR 2016 will become universally adopted and successfully address in practice all controversies of YAR 2004.
